End User License Agreement (EULA)

Please read this agreement carefully before using Twick

1. License Grant
Subject to your compliance with the terms of this Agreement, Twick grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Twick mobile application ("App") on your personal devices for your personal, non-commercial use.
2. Restrictions
You agree not to:
  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any proprietary notices or labels
  • Use the App for any illegal or unauthorized purpose
  • Interfere with or disrupt the App's servers or networks
  • Attempt to gain unauthorized access to any portion of the App
  • Use automated systems to access the App without permission
3. Intellectual Property
The App, including its design, graphics, code, and content, is owned by Twick and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved. You retain ownership of any content you create or upload through the App, but grant Twick a license to use, store, and process such content to provide the service.
4. User Content
  • You are solely responsible for all content you create, upload, or share through the App
  • You represent that you have the right to use and share any content you provide

  • You must immediately notify Twick of any unauthorized use of your account
  • You must be at least 13 years old to use the App
  • Twick reserves the right to suspend or terminate accounts that violate this Agreement
6. Service Availability
  • Twick strives to provide reliable service but does not guarantee uninterrupted or error-free operation
  • The App may be unavailable due to maintenance, updates, or technical issues
  • Twick reserves the right to modify, suspend, or discontinue any part of the service at any time
  • Twick is not responsible for any loss of data or functionality during service interruptions
7. Termination
  • You may terminate this Agreement at any time by deleting the App and your account
  • Twick may terminate or suspend your access immediately if you violate this Agreement
  • Upon termination, your right to use the App ceases immediately
  • Twick may delete your account data after a reasonable period following termination
  • Sections of this Agreement that by their nature should survive termination will remain in effect
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TWICK DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TWICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.
10. Indemnification
You agree to indemnify, defend, and hold harmless Twick and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App, violation of this Agreement, or infringement of any rights of another party.
11. Updates and Modifications
  • Twick may update the App from time to time, which may include bug fixes, new features, or changes to functionality
  • You may be required to update the App to continue using certain features
  • Twick may modify this Agreement at any time by posting the updated version
  • Your continued use of the App after changes constitutes acceptance of the modified Agreement
  • If you do not agree to the modifications, you must stop using the App
12. Third-Party Services
The App may integrate with third-party services (such as Google Sign-In, Apple Sign-In, and Serverpod Cloud). Your use of these services is subject to their respective terms and conditions. Twick is not responsible for the availability, accuracy, or content of third-party services.
13. Export Restrictions
You agree to comply with all applicable export and import laws and regulations. You may not export or re-export the App in violation of any applicable laws or regulations.
14. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Twick operates, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be resolved in the appropriate courts of that jurisdiction.
15. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.
16. Entire Agreement
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Twick regarding your use of the App and supersedes all prior agreements and understandings.
